Agreement

These Terms of Use ("Terms") govern your access to BirdX websites, web application (app.birdx.chat), and native apps. If you do not agree, do not use the service. BirdX is operated by iPmart Network.

Eligibility

You must be legally able to enter a binding agreement and meet any minimum age required in your country. You are responsible for ensuring your use of BirdX complies with local laws.

Your account

You must provide accurate registration information and keep your credentials confidential. You are responsible for all activity under your account. Notify us immediately at support@birdx.chat if you suspect unauthorized access. We recommend enabling two-factor authentication.

Acceptable use

You agree not to misuse BirdX. Prohibited conduct includes:

• Illegal activity, fraud, or harassment of other users.
• Distributing malware, phishing, or attempting to breach platform security.
• Spam, automated scraping, or overwhelming our infrastructure.
• Impersonation of BirdX staff or other users without permission.
• Uploading content that infringes intellectual property or privacy rights of others.

Content and moderation

You retain ownership of content you submit. You grant BirdX a limited license to host and transmit that content solely to operate the service. Community moderators and administrators may remove content or restrict accounts that violate rules or these Terms. Decisions may be appealed through support where your deployment provides that process.

Encryption and backups

End-to-end encrypted messages are designed so that only participants can read them. You are responsible for safeguarding your devices and backup codes. Lost keys or devices may result in inability to recover encrypted history.

Service availability

BirdX is provided "as is" and "as available." We strive for high uptime but do not guarantee uninterrupted or error-free operation. Maintenance, updates, or events beyond our control may cause temporary outages.

Disclaimer

To the fullest extent permitted by law, BirdX is provided without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. We do not warrant that the service will meet every requirement of your organization.

Limitation of liability

To the extent permitted by law, iPmart Network and BirdX shall not be liable for indirect, incidental, special, or consequential damages, or loss of data or profits, arising from your use of the service. Our aggregate liability for direct damages is limited to the amount you paid us for BirdX in the twelve months before the claim, or zero if the service is free to you.

Termination

You may stop using BirdX at any time. We may suspend or terminate access if you violate these Terms or if required for security or legal reasons. Upon termination, your right to use the service ends; provisions that should survive (liability limits, governing law) remain in effect.

Changes

We may modify these Terms. Material changes will be reflected in the "Last updated" date. Continued use after changes constitutes acceptance. If you disagree, discontinue use and contact support regarding account closure.
